1. Overview
Lutiq LLC ("Lutiq," "we," "us," or "our") operates an AI-driven landing-page optimization platform for e-commerce (Shopify) brands, and uses generative artificial intelligence ("AI") as a core part of that platform. This AI Transparency Statement explains, in plain language, how that AI is used, where humans remain in the loop, and what we do and do not train on. It is provided alongside — and should be read together with — our Privacy Policy (which in Part A covers Lutiq's own processing as a Business/controller, and in Part B covers data from shoppers on Lutiq-powered pages — where Lutiq acts both as a Service Provider delivering the service for the merchant and, for the data it uses to train and improve its own models, as a Business in its own right) and the Data Processing Addendum. The Services are offered in the United States only and are not directed to individuals located in the EEA, the United Kingdom, or Switzerland.
2. System Description
The Lutiq platform generates and optimizes landing-page experiences for e-commerce brands. At a high level, the system works as follows:
- Lutiq's models and algorithms propose hypotheses and content variants based on the brand's knowledge base — the product catalog, design tokens, imagery, and other materials the Brand Partner has authorized Lutiq to use
- Each variant is scored against cross-brand performance priors that reflect aggregated, de-identified historical performance patterns learned across the platform
- Lutiq's models and algorithms allocate traffic between variants, balancing exploration of new variants against continued use of variants already shown to convert well
- The Brand Partner can review and approve variants in the Lutiq dashboard
- Once a variant is live, it is served from the edge, and a first-party cookie set via the Lutiq Pixel can track engagement, attribution, and conversion
3. Customer Review and Approval
The Lutiq dashboard gives Customers the ability to review and approve variants, and to configure the degree of human review their account uses before variants go live. Once a variant is approved and published, the Customer — as the publisher of that content under Section 3.3 of the Terms of Service — is responsible for it.
4. What We Do and Don't Train On
We train Lutiq's own first-party models. Lutiq uses landing-page interaction and engagement data, conversion and purchase outcomes, and the customer and purchase data the merchant authorizes — from the merchant's connected e-commerce platform (such as Shopify) and/or the Lutiq Pixel, in the hashed and minimized form Lutiq stores it — to train and improve Lutiq's own optimization and attribution models — for example, learning which page experiences lead to engagement and to subsequent purchases. Knowing what a shopper purchases after clicking a Lutiq-served landing page is a core training signal. This learning improves the Services for Lutiq's customers generally, and the benefit flows between customers only through Lutiq's trained model parameters and aggregate statistical patterns — Lutiq never discloses one Brand Partner's raw data, customer records, or any individual consumer's identifiable profile to another Brand Partner. Shoppers may opt out of this use, as described in Section 7 below and in Part B of the Privacy Policy and Section 5A of the DPA. The models, prompts, and improvements that result from this training are Lutiq's property (see Terms §4.2 and §6).
We do not send end-customer personal data to third-party foundation models. Lutiq uses third-party large-language-model providers — currently OpenAI, Anthropic (Claude), Google (Gemini), DeepSeek, Moonshot AI (Kimi models), and Alibaba Cloud (Qwen models) — to generate and refine page content. The information Lutiq sends to them may include brand and product content authorized by the merchant and aggregate, non-identifying performance information; it does not include end-consumer (shopper) personal information or merchant personal information. Lutiq does not use end-customer personal data to train any third party's foundation models. Because no personal information is transmitted to them, these providers are not classified as Tier A or Tier B sub-processors; they are listed in Part C of the Privacy Policy for transparency.
5. Accuracy Disclaimer
AI outputs may contain inaccuracies, hallucinations, outdated claims, or content that — while fluent — is not appropriate for a particular product, audience, or jurisdiction. You must review each variant for accuracy, compliance with FTC advertising rules, and compliance with your own legal and regulatory obligations before approving it for publication. Generated Content is provided AS-IS, and Lutiq disclaims warranties of accuracy, completeness, non-infringement, or fitness for a particular purpose as to Generated Content, consistent with the Terms of Service.
6. Bias and Fairness
We monitor outputs for classes of content prohibited under Section 3 of the Terms of Service, including content that targets protected classes under federal, state, or local law. Section 3.2 prohibits using Lutiq to generate discriminatory content, non-consensual deepfakes, political disinformation, or content that violates the policies of advertising platforms. Where implemented, automated checks and sample-based review can help identify policy violations, but they are not guaranteed to catch every issue, and ultimate responsibility for approved content remains with the Customer.
7. Your Rights Under California Law
California residents have the right to know about Lutiq's use of automated systems in processing their personal information and the right to opt out of the "sale" or "sharing" of personal information. Lutiq does not sell personal information for money and does not share it for cross-context behavioral advertising; however, Lutiq's use of merchant-authorized "Permitted Data" to train its own models (Section 4) may constitute a "sale" or "sharing" under the CCPA/CPRA, and you may opt out. You can opt out via Global Privacy Control (GPC), which Lutiq honors automatically; by emailing [email protected]; or through the page at lutiq.com/privacy-request. On Shopify storefronts, Lutiq also gates on the merchant's Shopify Customer Privacy API consent flags. When a consumer opts out, Lutiq excludes their data from cross-brand model training. The AI processing described here does not produce legal or similarly significant effects on individual consumers — it selects which landing-page variant to show and measures engagement.
